01Introduction and Scope

This Privacy Policy explains how Kloude Technologies (“Kloude”, “we”, “us” or “our”), a registered business name of ASK CAPITAL PTY LTD, collects, uses, discloses, stores and otherwise handles personal information in connection with our website at kloude.com and our digital agency, web hosting, VPS and related services.

This policy applies to personal information we handle about our own website visitors, prospective customers, customers and their representatives. It does not govern how our customers handle personal information they store or process on websites, applications or servers hosted with us. Customers are responsible for their own privacy practices in relation to that content.

02Personal Information We Collect

Depending on how you interact with us, we may collect:

  • identity and contact details, such as your name, email address, company name and postal address;
  • enquiry details, such as the type of enquiry, project budget range and the content of your message;
  • account details, such as login credentials and account preferences, once customer accounts are available;
  • billing and transaction details, such as invoices, service orders and payment status;
  • technical information, such as IP addresses, browser type, device information and server or access logs;
  • communications with us, including support requests and correspondence;
  • project information you provide when engaging our agency services, which may include content, materials and access credentials for your systems.

We aim to collect only the personal information reasonably necessary for our functions and activities.

03How We Collect Information

We collect personal information directly from you where reasonably practicable, for example when you submit an enquiry form, email us, order or use a service, or work with us on a project. We may also collect information automatically when you use our website or services, and from third parties such as your authorised representatives or service providers acting on our behalf.

04Purposes for Collection and Use

We may collect, hold and use personal information to:

  • respond to enquiries and provide quotes;
  • provide, operate, maintain and support our agency, hosting and VPS services;
  • manage customer relationships, accounts, orders and billing;
  • verify orders and help protect our services against fraud, abuse and security threats;
  • communicate with you about your services, including service, security and administrative notices;
  • improve our website and services; and
  • comply with our legal obligations and resolve disputes.

05Account Registration and Hosting Services

When you register for or use our hosting or VPS services, we collect information needed to set up and manage your account and services, and we generate technical records such as service configuration, usage and log data.

Customer-hosted information. Customers may upload, store or process their own data, including personal information about their own users, on services hosted with Kloude. We provide the infrastructure on which that data is stored, but we do not routinely monitor, and are not able to inspect or control, all content customers store or process. We may access customer-hosted data only where reasonably necessary, for example to provide support you request, maintain or secure our services, investigate suspected misuse, or comply with the law.

Review: Confirm customer account registration process, any identity or order verification procedures, and the circumstances in which staff may access customer-hosted data.

06Website Enquiries and Contact Forms

When you submit our contact form, we collect the details you provide, such as your name, email address, company, enquiry type, budget range and message. We use this information to respond to your enquiry. Enquiry details are sent to our team by email, and we may send you a confirmation email.

To help prevent spam and abuse, we may process technical information such as your IP address when you submit the form.

Review: Confirm the email delivery provider used for form submissions and where enquiry emails are stored.

07Billing and Payment Information

When you purchase services, we collect billing information such as your name, billing address, the services ordered and payment status. Payment card details may be processed by a third-party payment provider rather than stored by us.

Review: Confirm the billing platform and payment processor(s) to be used, what payment data (if any) Kloude stores, and how tax and billing records are kept.

08Website Analytics, Cookies and Tracking

Our website may use cookies and similar technologies that are necessary for it to function, and may store limited preferences in your browser, such as your selected pricing currency.

Review: Confirm whether any analytics, advertising or tracking tools are used on kloude.com, which providers, and whether a cookie notice or consent mechanism is required.

09Service Providers and Third Parties

We may disclose personal information to third parties who help us operate our business and provide our services, such as infrastructure and data centre providers, software and control panel providers, email delivery providers, billing and payment providers, and professional advisers. We may also disclose information where required or authorised by law, or with your consent.

We do not sell personal information.

10Overseas Data Processing and Disclosure

Kloude operates infrastructure outside Australia, including in Singapore. Personal information, including customer-hosted data, may therefore be stored or processed overseas. Some of our service providers may also store or process information in other countries.

Review: Confirm the countries where personal information and customer data may be stored or processed, including service provider locations, and the steps taken in relation to overseas disclosure.

11Data Storage and Security

We take reasonable steps to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification or disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee the security of information.

Customers are responsible for securing their own websites, applications, accounts and credentials, and for maintaining independent copies of important data.

Review: Describe the security measures in place, if any are to be stated, and confirm the data breach response process.

12Retention and Deletion

We keep personal information only for as long as it is reasonably needed for the purposes described in this policy or as required by law. When it is no longer needed, we take reasonable steps to destroy or de-identify it.

Review: Confirm retention periods for enquiries, customer records, billing records, logs, backups and customer-hosted data after service cancellation.

13Accessing and Correcting Personal Information

You may request access to, or correction of, the personal information we hold about you by contacting us at hello@kloude.com. We may need to confirm your identity before responding. If we refuse a request, we will explain why where appropriate.
